Terms of Service

These Terms of Service (“Terms”) govern your access to and use of RevUp Control’s website, platform, and mobile applications (collectively, the “Services”) operated by RevUp Control (“we”, “our”, or “us”).

By using the Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

1. Eligibility & Accounts

You must be at least 18 years old and authorized to act on behalf of the organization you register.

You are responsible for:

  • Maintaining the confidentiality of login credentials

  • All activity under your account

  • Ensuring account accuracy and proper permissions for users within your organization

Notify us immediately at admin@revupcontrol.com if you suspect unauthorized access.

2. Authorized Use

You may use the Services solely for your internal business operations related to parts management and collision repair tracking.

You may not:

  • Reverse engineer, copy, or modify the platform

  • Access the Services to build a competing product

  • Circumvent security measures

  • Improperly access data belonging to other organizations

  • Upload harmful code, malicious files, or false data

We reserve the right to suspend or terminate access for violations.

3. Third-Party Integrations (Including CCC)

If you connect RevUp Control to CCC or other systems:

  • Access and usage of their data is governed by their own terms and permissions

  • RevUp Control only uses the synced data to provide features within the platform

  • You are responsible for maintaining necessary third-party accounts and agreements

  • Disconnection of integrations stops new data from syncing, but does not automatically remove historical data (see Privacy Policy).

4. Ownership of Data

You retain ownership of your operational data, including:

  • Parts status and inventory details

  • Vendor information

  • Repair Order metadata

You grant RevUp Control a license to process data for:

  • Operating and improving the Service

  • Support and troubleshooting

  • Analytics for performance and product enhancements

Data use is governed by our Privacy Policy.

5. Intellectual Property

All software, content, features, trademarks, and platform design are the exclusive property of RevUp Control. No ownership rights are transferred by using the Services.

6. Service Availability & Changes

We strive to provide reliable availability, but uptime is not guaranteed. We may improve, modify, or discontinue features at any time with or without prior notice.

We are not liable for:

  • Downtimes or accessibility issues

  • Losses resulting from service interruptions

7. Fees and Payments (For paid tiers)

If subscriptions are required:

  • Fees are billed according to the pricing plan you select

  • All payments are non-refundable unless required by law

  • We may suspend access if payment obligations are not met

  • Pricing changes will be communicated in advance.

(If currently free access — you may add a note such as “Early Access is currently free while features are under development.”)

8. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied.

We do not warrant that:

  • The Services will be error-free or uninterrupted

  • All defects will be corrected immediately

  • Data or workflows will meet operational or regulatory requirements

9. Limitation of Liability

To the fullest extent permitted by law, RevUp Control shall not be liable for:

  • Any indirect, incidental, special, or consequential damages

  • Lost profits, lost revenue, or operational losses

  • Errors or delays caused by third-party systems (including CCC integrations)

Total liability will not exceed the amount paid to us in the prior 12 months.

10. Termination

We may suspend or terminate access if:

  • These Terms are violated

  • Misuse, fraud, or unauthorized access is detected

  • Required payments are not completed

Upon termination, your right to use the Services ends immediately. You may request data export as permitted by our Privacy Policy.

11. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

12. Updates to Terms

We may update these Terms occasionally. Continued use after updates constitutes acceptance of the revised Terms.
